OUR PAYMENT TERMS
The Company is Matt Davies Mechanical of Falls Farm, Staploe, St Neots, Cambs, PE19 5JA whom all payments become due for goods and services provided. The purchaser, the individual, firm, partnership, or limited company, is "The Customer", the entity for whom the work has been completed.
1. OWNERSHIP: All materials provided by the Company or their sub-contractors remain the property of:
Matt Davies Mechanical until full and final payment has been received.
2. GUARANTEES: The guarantee will come into effect when the Company has received full payment. The Company will guarantee the quality of all new work and new materials used in construction or repairs for 12 months from the date of installation. The Company does not guarantee the integrity of any existing structures, materials, facials, or decorations. Guarantees on materials run in accordance with the manufacturer's warranty periods where applicable. In the event of a failure beyond the guarantee period, we will investigate the cause and negotiate a solution to the problem without delay and carry out any agreed repairs as soon as possible. Charges may apply for remedial work beyond guarantee dates or items not covered by our guarantee.
3. PARTS: Unless agreed advance and in writing, all parts must be paid in full prior to fitting and shall remain the property of the Company until payment has been cleared in full. At its discretion, the Company reserves the right to refuse to repair or replace any goods or equipment it feels may be detrimental to the safety of its staff. Special order parts are non-returnable. All parts held in stock will be subject to a 25% restocking fee.
4 CARRIAGE: The Company reserves the right to charge the customer carriage for transporting goods or equipment.
5. DISCOUNTS AND RETENTIONS: Any discount will only be approved and given by the Company and confirmed in writing. The Customer agrees that no retentions will be held unless expressly agreed by The Company in writing.
6. PAYMENT & LATE PAYMENT: We accept Bank Transfer, card, cheque, or cash. Payments by cheque payable are payable to Matt Davies Mechanical. For bank transfer, our account details are available upon request. Payment is due in full upon completion of works as detailed in the Quotation/Order, including any additional work. Goods or equipment will not be released without payment. The Company will only agree to part payments or interim payments before the commencement of work.
7. STORAGE: Customers must collect all goods and equipment within 14 days of notification; after that, a fee of £10 plus VAT per day for storage will be levied. After 30 days, any goods or equipment left without prior arrangement will be disposed of after 30 days written notice.
8. CALL OUT CHARGES: The Company charges a minimum charge of £44 plus VAT for the first hour, thereafter £44 per hour plus VAT calculated in 15 minutes increments. A mileage charge of £1 per mile each way plus VAT from PE19 5 JA is also chargeable.
8.1. The Customer agrees to settle all outstanding invoices upon presentation unless otherwise specified. For business-to-business transactions: In the event of late payment, the Company reserves the right to charge interest and compensation pursuant to the Late Payment of Commercial Debts Act 1998 and the Late Payment of Commercial Debts (Amendment) Regulations 2015. For non-business Customers: An administration fee of £35 plus VAT will be payable to cover our administration costs. The Company also reserves the right to charge interest at a rate of 5% above the Barclays Bank lending rate.
8.2. In the event of late or non-payment, the Company reserves the right to employ the services of a Debt Recovery Agency. The Customer agrees to indemnify The Company for the associated recovery costs incurred.
9. DISPUTES: Customers must notify the Company of any dispute in writing that arises within five workings days to Matt Davies Mechanical Falls Farm, Staploe, St Neots, Cambs, PE19 5JA. The Customer may not withhold, or delay payment or exercise any rights whatsoever howsoever arising which might otherwise be available to it. The Customer's statutory rights remain unaffected.
10. DATA PROTECTION: The Customer's information is retained according to The General Data Protection Regulation 2016/679 and will not be divulged by the Company to third parties except in preventing fraud and debt recovery.
